1 Participation Agreement

By enrolling in any program, event, or service offered by Red Shed Inc, including but not limited to rowing programs, community events, gym classes, and wellness services, participants agree to abide by the terms and conditions outlined herein and within the participant waiver.

2 Participant Waiver

By booking into any program, event, or service offered by Red Shed Inc, including but not limited to rowing programs, community events, gym classes, and wellness services, participants have agreed that they’ve read and understood the participant waiver available to them in the event, service or program description.

3 Health and Safety

Participants must ensure that they are in good health and free from any medical conditions that may prevent safe participation in the programs or use of the facilities and equipment provided by Red Shed Inc. It is recommended that participants consult with a physician before beginning any new exercise regimen or utilising wellness services. Participants will immediately notify Red Shed Inc in writing of any changes to their fitness and ability to participate in any program, event or service. If required, the participant acknowledges and agrees Red Shed Inc may arrange medical or hospital treatment (including without limitation, physical examination, first aid, defibrillation and safety boat and ambulance transportation) for them. The participant authorises such actions being taken by Red Shed Inc and agrees to meet all costs associated with such action.

4 Assumption of Risk

Participants acknowledge that participation in physical activities, including rowing, gym classes, and use of wellness facilities such as cold plunge, traditional Finnish sauna, infrared sauna, dry float bed, and EMS (Electronic Muscle Stimulation) machine, include many significant inherent risks. This is including, without limitation, risks of death, physical and mental injury, disease, loss and damage, and economic loss. The risks of physical injury may include, without limitation, the risk of drowning, serious head, neck and spinal injuries, brain damage, serious injuries to bones, joints, ligaments, muscles, tendons and other aspects of the muscular skeletal system, serious injury to internal organs, and serious injury or impairment to other aspects of the human body and to the individuals’ general health and well-being. The risks of mental injury may include, without limitation, risk of serious psychological and psychiatric injury.

5 Booking and Cancellation

Participants must book in advance for programs, classes, or wellness services. Cancellations must be made within the specified time frame to avoid penalties or forfeiture of fees. Authorised staff of Red Shed Inc may revoke paid bookings if participants conduct themselves in an inappropriate behaviour against the Red Shed Code of Conduct. In that case, all relevant paid bookings will be re-credited to the participants account. No refunds are processed unless a valid reason is provided and accepted by the committee.

    • Rowing – cancellations need to be made 24-hours prior to bookings for casual sessions/events and 48-hours prior to the first day of any 5 or 10 week programs. No refunds/make up lessons are provided, rather an account credit will be added for future use. A 20% administration fee applies when changing program costs.
    • Gym & Wellness – cancellations need to be made 24-hours prior to casual bookings.
    • Memberships: Members are locked in for 8 weeks with a 2-week notice period. To cancel, members must email info@redshed.org.au. Memberships can be frozen for a minimum of 2 weeks, with a maximum of 8 weeks in one year.
    • Red Shed memberships are non-refundable.

6 Late Pickup Policy

Parents/guardians are responsible for picking up their child on time at the conclusion of each session. A late pickup fee of $15 will be charged for every 15 minutes (or part thereof) past the scheduled end time. This fee must be paid before the child can attend future sessions.

7 Supervision and Instruction

Participants agree to follow the instructions provided by Red Shed Inc staff and coaches during programs and classes. Participants understand that failure to follow instructions may increase the risk of injury and may result in removal from the program or facility.

8 Use of Facilities and Equipment

Participants agree to use the facilities and equipment provided by Red Shed Inc in a safe and responsible manner. Any misuse or damage to the facilities or equipment caused by a participant’s negligence may result in financial liability for repair or replacement. Such behaviour may warrant exclusion to future Red Shed activities and/or access to the facility

9 Weather Policy

In cases of unsuitable weather conditions, such as thunderstorms, high winds, extreme heat, or any other conditions considered unsafe for outdoor activities, Red Shed Inc reserves the right to move outdoor programs indoors for the safety of participants. Participants may be notified of any changes to the program location via email or phone.

10 Code of Conduct

Participants are expected to conduct themselves in a respectful and courteous manner towards staff and fellow participants, as outlined in the Red Shed Code of Conduct. Any behaviour deemed inappropriate, disruptive, or unsafe may result in removal from the program or facility.

11 Personal Belongings

Red Shed Inc is not responsible for any loss or damage to personal belongings brought onto the premises by participants. Participants are encouraged to secure their belongings in provided lockers or designated areas.

12 Photography and Marketing

Red Shed Inc reserves the right to use photographs or videos taken during programs, events, or classes for promotional purposes. Participants who do not wish to be photographed or filmed must notify Red Shed Inc staff in writing. Participants acknowledge that Red Shed Inc may make, create, store, record, transmit, reproduce photographs and electronic images of participants. Participants consent that Red Shed Inc, or their authorised third parties, may use these photographs or images for proper purpose without identification or compensation of any kind.

13 Surveillance of Venues

Red Shed Inc premises are subject to video and at times audio surveillance for security reasons. Details of suspected or actual illegal and/or undesirable activities on Red Shed Inc premises may be shared with Red Shed Inc authorities and law enforcement bodies.

14 Privacy

Participants consent to the collection of their personal information by Red Shed Inc in connection with their involvement in any activity and the use and disclosure of their personal information by the Red Shed Inc to other agencies and officials associated with the relevant activity for the purposes of conducting and managing the activity. Participants understand that they may gain access to their personal information held by Red Shed Inc by contacting the and requesting access. The participant understands that if they do not provide their personal information, they may not be permitted to participate in a Red Shed activity. Further details on how Red Shed Inc collects, holds and discloses personal information can be found in the Red Shed Privacy Policy.

15 Intellectual Property

The website of Red Shed Inc and its original content, features and functionality are owned by Red Shed Inc and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

16 Modifications and Amendments

Red Shed Inc reserves the right to modify or amend these terms and conditions at any time without prior notice. Participants will be notified of any changes via email or through posting on the Red Shed Inc website.

17 Easter School Holidays Rowing Program - 7 FREE Spots

Terms and Conditions – Red Shed April School Holiday Rowing Program Competition

1. Promoter
This competition is conducted by Red Shed Inc (the “Promoter”), a not-for-profit organisation based in the ACT.

2. Eligibility
2.1. This competition is open to high school students residing in the Australian Capital Territory (ACT).
2.2. Employees of Red Shed Inc and their immediate family members are not eligible to enter.

3. How to Enter
3.1. To enter, participants must provide their full name and email address via the official entry form available on the Red Shed website under the School Holiday Program page.

4. Promotion Period
4.1. The competition commences on 17 February 2025 and closes at 11:59pm AEST on 21 March 2025. Entries received outside this period will not be valid.

5. Prizes
5.1. There are seven (7) free spots in the April School Holiday Rowing Program to be won, each valued at $280 AUD. These spots are for the 1-4pm program on the week commencing 14 April 2025. The prizes are non-transferable and cannot be redeemed for cash or any other alternatives.
5.2. The total prize pool is $1,960 AUD.

6. Draw and Winner Selection
6.1. The winners will be determined by a random draw conducted via an automated online random selection system to ensure fairness and transparency.
6.2. The draw will take place on site at Red Shed on the 24 March at 12:00pm AEST.
6.3. Each participant is eligible to win only one prize. If the same participant is drawn more than once, the draw will be repeated to determine a new winner.

7. Notification of Winners
7.1. Winners will be notified via email on 24 March.
7.2. Winners must respond to confirm acceptance of their prize 3-days after they receive the congratulations email from Red Shed. Failure to do so may result in the prize being forfeited and a redraw conducted.

8. Privacy
8.1. Personal information collected as part of the competition will be handled in accordance with Red Shed Inc’s privacy policy and used solely for the purposes of administering the competition. Personal information will not be shared with third parties without consent.

9. General Conditions
9.1. The Promoter reserves the right to verify the eligibility of entries and disqualify any entry that does not comply with these Terms and Conditions.
9.2. The Promoter accepts no responsibility for late, lost, or misdirected entries due to technical or other failures outside its control.
9.3. This competition is conducted in accordance with ACT law and Red Shed Inc’s obligations as a not-for-profit organisation.

10. Limitation of Liability
To the extent permitted by law, the Promoter will not be liable for any loss, damage, or injury incurred by the winners or participants in connection with this competition or the use of the prizes.

18 Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of ACT, Australia. Any disputes arising out of or related to these terms and conditions shall be resolved exclusively through the courts of ACT, Australia.
